Litigation

I feel that litigation should be avoided if at all possible. Litigation is expensive, time-consuming, emotionally draining, and only one side can win. I handle many kinds of disputes and make every effort to settle them without having to go to trial. For example:

  • Employment – disability discrimination, failure to provide Family and Medical Leave Act benefits, violations of Fair Labor Standards Act
  • Insurance – failure to pay on a claim
  • Will contests – testator forced to change his will
  • Elder care – nursing home refuses to re-admit patient after hospital stay
  • Special Education – school refuses to provide services the child needs to learn
  • Contract - auto shop charged more than the estimate, roofer did a horrible job
  • Partnership – partners have a fight and want to end the business
  • Landlord/Tenant – landlord refuses to give credit against the rent for work done by the tenant despite a verbal agreement

I am frequently able to negotiate and come to an agreement that is satisfactory to both sides without having to charge large fees.
